Discovery to forego the prepayment of $10,000 that accompanies a Request for Service.  In addition, Discovery is willing to provide service under its rate schedules without receipt of the Request for Service provided all required information has been received and satisfies the specific requirements contained in the tariff except as noted above.  Such information can be received by writing, telephone, internet or other manner within the proper time period.  Discovery reserves the right to enforce these provisions upon subsequent notification.

General Terms and Conditions Page 194, Section 23.1

Transporter agrees to relax, on a temporary basis, the temperature specifications for gas from no greater than 100 degrees F. to no greater than 120 degrees F.

Gas must be dehydrated pursuant to the item directly above, and temperatures cannot cause Transporter to experience operational integrity and/or measurement problems.

Pursuant to Section 23.1 of Discovery's FERC Gas Tariff, Discovery is waiving application of the imbalance cashout tiers to Shipper for November 2007.

 Discrepancy in estimated PTR and the actual PTR resulted in a cashout penalty position.
